Moped teenage driver killed by dump truck near Boston
A 17- year-old boy driving a moped was killed after being hit by a dump truck in Dedham, Massachusetts, on Tuesday, authorities said. According to the Norfolk District Attorney’s Office, the crash took place on Washington Street, near the border of Boston’s West Roxbury neighborhood. The passenger on the moped was also injured in the accident. Eyewitnesses told the press they couldn’t understand how the crash occurred as the street was deserted and the dump truck driver couldn’t have missed the teenagers on the moped.
Who is liable for damages in a crash caused by a dump truck?
Due to their large size, garbage trucks can be a menace to motorists, motorcyclists, and bicyclists. They can also be unpredictable in their operation, as they stop at random points or park in travel lanes.
If you are involved in a crash caused by a dump truck in Boston, the parties you can potentially sue will depend on the specific circumstances of the accident. Generally, you may have grounds to sue the dump truck driver, the trucking company that employs the driver, and the owner of the dump truck. You may also have a case against any third parties who contributed to the cause of the accident, such as a maintenance company responsible for servicing the truck or a manufacturer of a faulty truck part.
Truck accidents often result in severe, life-changing injuries and the financial consequences can be enormous. It is very important to consult with an experienced Boston truck accident attorney who can help determine who can be held accountable for damages. Keep in mind that truck drivers only have basic insurance, which may not cover your
immediate medical expenses, let alone long-term care, lost future earnings, or the compensation you’re entitled to for your pain and suffering.
After a garbage truck accident, you may have a personal injury claim against the driver involved in the crash and the company that employed the driver, no matter if it’s a private or public company. This is possible under the vicarious liability legal doctrine. According to Massachusetts law, employers will be held accountable for the negligent acts that their employees commit during the course and scope of employment.
Can you sue local authorities for a dump truck accident?
If the City of Boston owns the garbage truck and employs the driver who caused the crash, your lawyers can help you file a claim against the city.
When suing a government entity, you will first have to file a “Notice of Claim”. Failure to do this could invalidate your claim entirely. The notice should include a brief description of the accident, the extent of the injuries you sustained, and the amount of damages you seek. Your lawyers will tell you how much your claim is worth.
If the city’s lawyers consider the truck driver was responsible, they may agree to settle rather than face a trial they’re most likely to lose. On the other hand, if they dispute liability, they will deny your claim so your lawyers will start working on the lawsuit.
